The Forgiveness to Come
The Holocaust and the Hyper-Ethical

This book is concerned with the aporias, or impasses, of forgiveness, especially in relation to the legacy of the crimes against humanity perpetrated by the Nazis and their collaborators during World War II. Banki argues that, while forgiveness of the Holocaust is and will remain impossible, we cannot rest upon that impossibility. Rather, the impossibility of forgiveness must be thought in another way. In an epoch of "worldwidization," we may not be able simply to escape the violence of scenes and rhetoric that repeatedly portray apology, reconciliation, and forgiveness as accomplishable acts. Accompanied by Jacques Derrida's thought of forgiveness of the unforgivable, and its elaboration in relation to crimes against humanity, the book undertakes close readings of literary, philosophical, and cinematic texts by Simon Wiesenthal, Jean Améry, Vladimir Jankélévitch, Robert Antelme and Eva Mozes Kor. These texts contend with the idea that the crimes of the Nazis are inexpiable, that they lie beyond any possible atonement or repair. Banki argues that the juridical concept of crimes against humanity calls for a thought of forgiveness-one that would not imply closure of the infinite wounds of the past. How could such a forgiveness be thought or dreamed? Banki shows that if today we cannot simply escape the "worldwidization" of forgiveness, then it is necessary to rethink what forgiveness is, the conditions under which it supposedly takes place, and especially its relation to justice.

Drawing the Line examines the ways in which cultural, political, and legal lines are imagined, drawn, crossed, erased, and redrawn in post-apartheid South Africa-through literary texts, artworks, and other forms of cultural production. Under the rubric of a philosophy of the limit, and with reference to a range of signifying acts and events, this book asks what it takes to recalibrate a sociopolitical scene, shifting perceptions of what counts and what matters, of what can be seen and heard, of what can be valued or regarded as meaningful. The book thus argues for an aesthetics of transitional justice and makes an appeal for a post-apartheid aesthetic inquiry, as opposed to simply a political or a legal one. Each chapter brings a South African artwork, text, speech, building, or social encounter into conversation with debates in critical theory and continental philosophy, asking: What challenge do these South African acts of signification and resignification pose to current literary-philosophical debates?

Slavery, Primitivism, And Political Freedom

Critics have claimed that Jean-Jacques Rousseau was a primitivist uncritically preoccupied with "noble savages" and that he remained oblivious to the African slave trade. Fugitive Rousseau presents the emancipatory possibilities of Rousseau's thought and argues that a fresh, "fugitive" perspective on political freedom is bound up with Rousseau's treatments of primitivism and slavery. Rather than trace Rousseau's arguments primarily to the social contract tradition of Hobbes and Locke, Fugitive Rousseau places Rousseau squarely in two imperial contexts: European empire in his contemporary Atlantic world and Roman imperial philosophy. The Mandate of Dignity
Ronald Dworkin, Revolutionary Constitutionalism, and the Claims of Justice

A major American legal thinker, the late Ronald Dworkin also helped shape new dispensations in the Global South. In South Africa, in particular, his work has been fiercely debated in the context of one of the world's most progressive constitutions. Despite Dworkin's discomfort with that document's enshrinement of "socioeconomic rights," his work enables an important defense of a jurisprudence premised on justice, rather than on legitimacy. Beginning with a critical overview of Dworkin's work culminating in his two principles of dignity, Cornell and Friedman turn to Kant and Hegel for an approach better able to ground the principles of dignity Dworkin advocates. Framed thus, Dworkin's challenge to legal positivism enables a theory of constitutional revolution in which existing legal structures are transformatively revalued according to ethical mandates. By founding law on dignity, Dworkin begins to articulate an ethical jurisprudence responsive to the lived experience of injustice. More than a purely philosophical problem, straddling the ambivalent terrain between necessity and impossibility, contingency has become the very horizon of everyday life. Often used as a synonym for the precariousness of working conditions under neoliberalism, for the unknown threats posed by terrorism, or for the uncertain future of the planet itself, contingency needs to be calculated and controlled in the name of the protection of life.
The overcoming of contingency is not only called upon to justify questionable mechanisms of political control, it serves as a central legitimating factor for Enlightenment itself. In this volume, nine major philosophers and theorists address a range of questions around contingency and moral philosophy. How can we rethink contingency in its creative aspects, outside the dominant rhetoric of risk and dangerous exposure? What is the status of contingency- as the unnecessary and law-defying-in or for ethics? What Fanon Said
A Philosophical Introduction To His Life And Thought

Antiblack racism avows reason is white while emotion, and thus supposedly unreason, is black. Challenging academic adherence to this notion, Lewis R. Gordon offers a portrait of Martinican-turned-Algerian revolutionary psychiatrist and philosopher Frantz Fanon as an exemplar of "living thought" against forms of reason marked by colonialism and racism. Working from his own translations of the original French texts, Gordon critically engages everything in Fanon from dialectics, ethics, existentialism, and humanism to philosophical anthropology, phenomenology, and political theory as well as psychiatry and psychoanalysis. Gordon takes into account scholars from across the Global South to address controversies around Fanon's writings on gender and sexuality as well as political violence and the social underclass. In doing so, he confronts the replication of a colonial and racist geography of reason, allowing theorists from the Global South to emerge as interlocutors alongside northern ones in a move that exemplifies what, Gordon argues, Fanon represented in his plea to establish newer and healthier human relationships beyond colonial paradigms.

From the 1811 German Coast Slave Rebellion to the 1971 Attica Prison Uprising, from the truancy of enslaved women to the extreme self-discipline exercised by prisoners in solitary confinement, Black Americans have, through time, resisted racial regimes in extraordinary and everyday ways. Though these acts of large and small-scale resistance to slavery and incarceration are radical and transformative, they have often gone unnoticed. This book is about Black rebellion in captivity and the ways that many of the conventional well-worn constructs of academic political theory render its political dimensions obscure and indiscernible. While Hannah Arendt is an unlikely theorist to figure prominently in any discussion of Black politics, her concepts of world and worldlessness offer an indispensable framework for articulating a theory of resistance to chattel and carceral captivity.
Politics in Captivity begins by taking seriously the ways in which slavery and incarceration share important commonalities, including historical continuity. In Zuckerwise's account of this commonality, the point of connection between enslaved and incarcerated people is not exploited labor, but rather resistance. The relations between the rebellions of both groups appear in the writings of Muhammed Ahmad, Angela Davis, George Jackson, Ruchell Magee, and Assata Shakur, a genre Zuckerwise calls Black carceral political thought. The insights of these thinkers and activists figure into Zuckerwise's analyses of largescale uprisings and quotidian practices of resistance, which she conceives as acts of world-building, against conditions of forced worldlessness. In a moment when a collective racial reckoning is underway; when Critical Race Theory is a target of the Right; when prison abolition has become more prominent in mainstream political discourse, it is now more important than ever to look to historical and contemporary practices of resistance to white domination.

Thresholds of Illiteracy reevaluates Latin American theories and narratives of cultural resistance by advancing the concept of "illiteracy" as a new critical approach to understanding scenes or moments of social antagonism. "Illiteracy," Acosta claims, can offer us a way of talking about what cannot be subsumed within prevailing modes of reading, such as the opposition between writing and orality, that have frequently been deployed to distinguish between modern and archaic peoples and societies. This book is organized as a series of literary and cultural analyses of internationally recognized postcolonial narratives. Punishment and Inclusion
Race, Membership, and the Limits of American Liberalism

At the start of the twenty-first century, 1 percent of the U.S. population is behind bars. An additional 3 percent is on parole or probation. In all but two states, incarcerated felons cannot vote, and in three states felon disenfranchisement is for life. More than 5 million adult Americans cannot vote because of a felony-class criminal conviction, meaning that more than 2 percent of otherwise eligible voters are stripped of their political rights. Nationally, fully a third of the disenfranchised are African American, effectively disenfranchising 8 percent of all African Americans in the United States. In Alabama, Kentucky, and Florida, one in every five adult African Americans cannot vote. Punishment and Inclusion gives a theoretical and historical account of this pernicious practice of felon disenfranchisement, drawing widely on early modern political philosophy, continental and postcolonial political thought, critical race theory, feminist philosophy, disability theory, critical legal studies, and archival research into state constitutional conventions. It demonstrates that the history of felon disenfranchisement, rooted in post-slavery restrictions on suffrage and the contemporaneous emergence of the modern "American" penal system, reveals the deep connections between two political institutions often thought to be separate, showing the work of membership done by the criminal punishment system and the work of punishment done by the electoral franchise. Felon disenfranchisement is a symptom of the tension that persists in democratic politics between membership and punishment. This book shows how this tension is managed via the persistence of white supremacy in contemporary regimes of punishment and governance.
Creolizing Political Theory
Reading Rousseau Through Fanon

Might creolization offer political theory an approach that would better reflect the heterogeneity of political life? After all, it describes mixtures that were not supposed to have emerged in the plantation societies of the Caribbean but did so through their capacity to exemplify living culture, thought, and political practice. Similar processes continue today, when people who once were strangers find themselves unequal co-occupants of new political locations they both seek to call "home." Unlike multiculturalism, in which different cultures are thought to co-exist relatively separately, creolization describes how people reinterpret themselves through interaction with one another. While indebted to comparative political theory, Gordon offers a critique of comparison by demonstrating the generative capacity of creolizing methodologies. She does so by bringing together the eighteenth-century revolutionary Swiss thinker Jean-Jacques Rousseau and the twentieth-century Martinican-born Algerian liberationist Frantz Fanon. While both provocatively challenged whether we can study the world in ways that do not duplicate the prejudices that sustain its inequalities, Fanon, she argues, outlined a vision of how to bring into being the democratically legitimate alternatives that Rousseau mainly imagined.
