A radical vision for the future of human rights as a fundamentally reconfigured framework for global justice. Reinventing Human Rights offers a bold argument: that only a radically reformulated approach to human rights will prove adequate to confront and overcome the most consequential global problems. Charting a new path-away from either common critiques of the various incapacities of the international human rights system or advocacy for the status quo-Mark Goodale offers a new vision for human rights as a basis for collective action and moral renewal. Goodale's proposition to reinvent human rights begins with a deep unpacking of human rights institutionalism and political theory in order to give priority to the "practice of human rights." Rather than a priori claims to universality, he calls for a working theory of human rights defined by "translocality," a conceptual and ethical grounding that invites people to form alliances beyond established boundaries of community, nation, race, or religious identity. The Subject of Human Rights is the first book to systematically address the "human" part of "human rights." Drawing on the finest thinking in political theory, cultural studies, history, law, anthropology, and literary studies, this volume examines how human rights-as discourse, law, and practice-shape how we understand humanity and human beings. It asks how the humanness that the human rights idea seeks to protect and promote is experienced. The essays in this volume consider how human rights norms and practices affect the way we relate to ourselves, to other people, and to the nonhuman world. They investigate what kinds of institutions and actors are subjected to human rights and are charged with respecting their demands and realizing their aspirations. And they explore how human rights shape and even create the very subjects they seek to protect. Through critical reflection on these issues, The Subject of Human Rights suggests ways in which we might reimagine the relationship between human rights and subjectivity with a view to benefiting human rights and subjects alike.

Established as a post-World War II response to conflict and fascism, the European Court of Human Rights is routinely characterized as the most successful human rights institution in the world. Based in Strasbourg, France, its jurisdiction extends to over 700 million people on European soil across the 46 Council of Europe member countries. The Court is the crown jewel of the Council, an international organization dedicated to human rights, democracy, and the rule of law. And yet, for years, European institutions have been haunted by the specter of failure. In the shadow of rising populism, inequality, and war, faith in democracy and the rule of law has been shaken to its core. Drawing on extensive fieldwork conducted over eight years with human rights advocates, lawyers, and judges at the European Court of Human Rights, this book asks: What kind of justice is possible through law? Drawing on participant observation, in-depth interviews, and archival research, Jessica Greenberg tracks two paradoxical experiences of the European human rights system and the Court: on the one hand, the Court as a bureaucratic "machine;" on the other, the Court as the "conscience of Europe." She argues that human rights frameworks fuel imaginative approaches to social change, and compel legal actors to creatively navigate institutions through advocacy, persuasion, and innovative interpretation of what the law is and what it should be.

A new moral, ethical, and legal framework is needed for international human rights law. Never in human history has there been such an elaborate international system for human rights, yet from massive disasters, such as the Darfur genocide, to everyday tragedies, such as female genital mutilation, human rights abuses continue at an alarming rate. As the world population increases and global trade brings new wealth as well as new problems, international law can and should respond better to those who live in fear of violence, neglect, or harm. Modern critiques global human rights fall into three categories: sovereignty, culture, and civil society. These are not new problems, but have long been debated as part of the legal philosophical tradition. Taking lessons from tradition and recasting them in contemporary light, Helen Stacy proposes new approaches to fill the gaps in current approaches: relational sovereignty, reciprocal adjudication, and regional human rights. She forcefully argues that law and courts must play a vital role in forging a better human rights vision in the future.

The Rise and Fall of Human Rights provides a groundbreaking ethnographic investigation of the Palestinian human rights world-its NGOs, activists, and "victims," as well as their politics, training, and discourse-since 1979. Though human rights activity began as a means of struggle against the Israeli occupation, in failing to end the Israeli occupation, protect basic human rights, or establish an accountable Palestinian government, the human rights industry has become the object of cynicism for many Palestinians. But far from indicating apathy, such cynicism generates a productive critique of domestic politics and Western interventionism. This book illuminates the successes and failures of Palestinians' varied engagements with human rights in their quest for independence.

Surrendering to Utopia is a critical and wide-ranging study of anthropology's contributions to human rights. Providing a unique window into the underlying political and intellectual currents that have shaped human rights in the postwar period, this ambitious work opens up new opportunities for research, analysis, and political action. At the book's core, the author describes a "well-tempered human rights"-an orientation to human rights in the twenty-first century that is shaped by a sense of humility, an appreciation for the disorienting fact of multiplicity, and a willingness to make the mundaneness of social practice a source of ethical inspiration. Specifically, it shows where the sweeping colonial logics of Western law meets the lived experiences, accumulated histories, and humanitarian debts present in post-colonial Zimbabwe. Through a comprehensive survey of human rights scholarship, Shannon Morreira explores the ways in which the global framework of human rights is locally interpreted, constituted, and contested in Harare, Zimbabwe, and Musina and Cape Town, South Africa. Central American countries have long defined health as a human right. But in recent years regional trade agreements have ushered in aggressive intellectual property reforms, undermining this conception. Questions of IP and health provisions are pivotal to both human rights advocacy and "free" trade policy, and as this book chronicles, complex political battles have developed across the region. Looking at events in Costa Rica, El Salvador, and Guatemala, Angelina Godoy argues that human rights advocates need to approach intellectual property law as more than simply a roster of regulations. IP represents the cutting edge of a global tendency to value all things in market terms: Life forms-from plants to human genetic sequences-are rendered commodities, and substances necessary to sustain life-medicines-are restricted to insure corporate profits. If we argue only over the terms of IP protection without confronting the underlying logic governing our trade agreements, then human rights advocates will lose even when they win.

Bodies of Truth offers an intimate account of how apartheid victims deal with the long-term effects of violence, focusing on the intertwined themes of embodiment, injury, victimhood, and memory. In 2002, victims of apartheid-era violence filed suit against multinational corporations, accusing them of aiding and abetting the security forces of the apartheid regime. While the litigation made its way through the U.S. courts, thousands of victims of gross human rights violations have had to cope with painful memories of violence. They have also confronted an official discourse claiming that the Truth and Reconciliation Commission of the 1990s sufficiently addressed past injuries. This book shows victims' attempts to emancipate from their experiences by participating in legal actions, but also by creating new forms of sociality among themselves and in relation to broader South African society. Rita Kesselring's ethnography draws on long-term research with members of the victim support group Khulumani and critical analysis of legal proceedings related to apartheid-era injury. Using juridical intervention as an entry point into the question of subjectivity, Kesselring asks how victimhood is experienced in the everyday for the women and men living on the periphery of Cape Town and in other parts of the country. She argues that the everyday practices of the survivors must be taken up by the state and broader society to allow for inclusive social change in a post-conflict setting.

We live in a time when the most appalling social injustices and unjust human sufferings no longer seem to generate the moral indignation and the political will needed both to combat them effectively and to create a more just and fair society. If God Were a Human Rights Activist aims to strengthen the organization and the determination of all those who have not given up the struggle for a better society, and specifically those that have done so under the banner of human rights. It discusses the challenges to human rights arising from religious movements and political theologies that claim the presence of religion in the public sphere. Increasingly globalized, such movements and the theologies sustaining them promote discourses of human dignity that rival, and often contradict, the one underlying secular human rights. Conventional or hegemonic human rights thinking lacks the necessary theoretical and analytical tools to position itself in relation to such movements and theologies; even worse, it does not understand the importance of doing so. It applies the same abstract recipe across the board, hoping that thereby the nature of alternative discourses and ideologies will be reduced to local specificities with no impact on the universal canon of human rights. As this strategy proves increasingly lacking, this book aims to demonstrate that only a counter-hegemonic conception of human rights can adequately face such challenges.

Understanding the various meanings given to human and citizenship rights in Argentina is an important task, particularly so given the nation's prominence in global discussions. An "exporter" of tactics, ideas, and experts, Argentina has become a site of innovation in the field of human rights. This book investigates two prominent Buenos Aires protest organizations-Memoria Activa and the BAUEN workers' cooperative-to consider how each has framed its demands within a language of rights. Fundamentally, this book is concerned with the complex interrelationship between the discourse of human rights and the neoliberal project. In exploring the way in which "rights talk" is used and adapted locally by various activist groups, the book looks at the mutually formative and contentious interactions between ideas of human rights, rights of citizenship, and the concrete and envisioned social relationships that form the basis for social activism in the wake of neoliberalism.

When Misfortune Becomes Injustice surveys the progress and challenges in deploying human rights to advance health and social equality over recent decades. Perpetrators of mass violence are commonly regarded as evil. Their violent nature is believed to make them commit heinous crimes as members of state agencies, insurgencies, terrorist organizations, or racist and supremacist groups. Upon close examination, however, perpetrators are contradictory human beings who often lead unsettlingly ordinary and uneventful lives. Drawing on decades of on-the-ground research with perpetrators of genocide, mass violence, and enforced disappearances in Cambodia and Argentina, Antonius Robben and Alex Hinton explore how researchers go about not just interviewing and writing about perpetrators, but also processing their own emotions and considering how the personal and interpersonal impact of this sort of research informs the texts that emerge from them. Through interlinked ethnographic essays, methodological and theoretical reflections, and dialogues between the two authors, this thought-provoking book conveys practical wisdom for the benefit of other researchers who face ruthless perpetrators and experience turbulent emotions when listening to perpetrators and their victims. Perpetrators rarely regard themselves as such, and fieldwork with perpetrators makes for situations freighted with emotion. For decades, the outside world mostly knew Myanmar as the site of a valiant human rights struggle against an oppressive military regime, predominantly through the figure of Nobel Peace Prize winner Aung San Suu Kyi. And yet, a closer look at Burmese grassroots sentiments reveals a significant schism between elite human rights cosmopolitans and subaltern Burmese subjects maneuvering under brutal and negligent governance. While elites have endorsed human rights logics, subalterns are ambivalent, often going so far as to refuse rights themselves, seeing in them no more than empty promises. Such alternative perspectives became apparent during Burma's much-lauded decade-long "transition" from military rule that began in 2011, a period of massive change that saw an explosion of political and social activism. How then do people conduct politics when they lack the legally and symbolically stabilizing force of "rights" to guarantee their incursions against injustice? In this book, Elliott Prasse-Freeman documents grassroots political activists who advocate for workers and peasants across Burma, covering not only the so-called "democratic transition" from 2011-2021, but also the February 2021 military coup that ended that experiment and the ongoing mass uprising against it. Taking the reader from protest camps, to flop houses, to prisons, and presenting practices as varied as courtroom immolation, occult cursing ceremonies, and land reoccupations, Rights Refused shows how Burmese subaltern politics compel us to reconsider how rights frameworks operate everywhere.

Contemporary feminist advocacy in human rights, international criminal law, and peace and security is gripped by the issue of sexual violence in conflict. But it hasn't always been this way. Analyzing feminist international legal and political work over the past three decades, Karen Engle argues that it was not inevitable that sexual violence in conflict would become such a prominent issue. Engle reveals that as feminists from around the world began to pay an enormous amount of attention to sexual violence in conflict, they often did so at the cost of attention to other issues, including the anti-militarism of the women's peace movement; critiques of economic maldistribution, imperialism, and cultural essentialism by feminists from the global South; and the sex-positive positions of many feminists involved in debates about sex work and pornography. The Grip of Sexual Violence in Conflict offers a detailed examination of how these feminist commitments were not merely deprioritized, but undermined, by efforts to address the issue of sexual violence in conflict. Engle's analysis reinvigorates vital debates about feminist goals and priorities, and spurs readers to question much of today's common sense about the causes, effects, and proper responses to sexual violence in conflict.

Social justice and human rights movements are entering a new phase. Social media, artificial intelligence, and digital forensics are reshaping advocacy and compliance. Technicians, lawmakers, and advocates, sometimes in collaboration with the private sector, have increasingly gravitated toward the possibilities and dangers inherent in the nonhuman. #HumanRights examines how new technologies interact with older models of rights claiming and communication, influencing and reshaping the modern-day pursuit of justice. Ronald Niezen argues that the impacts of information technologies on human rights are not found through an exclusive focus on sophisticated, expert-driven forms of data management but in considering how these technologies are interacting with other, "traditional" forms of media to produce new avenues of expression, public sympathy, redress of grievances, and sources of the self. Niezen considers various ways that the pursuit of justice is happening via new technologies, including crowdsourcing, social media-facilitated mobilizations (and enclosures), WhatsApp activist networks, and the selective attention of Google's search engine algorithm. He uncovers how emerging technologies of data management and social media influence the ways that human rights claimants and their allies pursue justice, and the "new victimology" that prioritizes and represents strategic lives and types of violence over others. #HumanRights paints a striking and important panoramic picture of the contest between authoritarianism and the new tools by which people attempt to leverage human rights and bring the powerful to account.

Against the backdrop of the global refugee crisis, Unsettled Families investigates the parameters that Global North governments and international humanitarian organizations use to classify most displaced families-more than 99% globally-as ineligible for resettlement, and often as fraudulent. But "fraud" as a category is not as self-evident as it may first appear. Nor is "the family." Based on long-term fieldwork between Nairobi, Kenya and Columbus, Ohio, Sophia Balakian tells stories of Somali and Congolese refugees navigating a complicated global assemblage of humanitarian organizations, immigration bureaucracies, and national security agencies as they seek permanent, new homes. Viewing the concepts of "fraud" and "family" from different vantage points in this context, Balakian shows how the categories begin to blur out of focus, sometimes to evaporate altogether; what seems to be contained within them scatter outside their received boundaries. Practices that resettlement organizations deem fraudulent are often understood by people living as refugees to be moral actions in an unequal world. Such practices allow them to fulfill obligations to kin-kin defined expansively, in ways that at times exceed the boundaries of normative, US frameworks. Bringing questions of kinship into current discussions on humanitarianism, Balakian locates "the family" as a crucial category in processes of producing, policing, and contesting the boundaries of nation-states in the 21st century.

The mass graves from our long human history of genocide, massacres, and violent conflict form an underground map of atrocity that stretches across the planet's surface. In the past few decades, due to rapidly developing technologies and a powerful global human rights movement, the scientific study of those graves has become a standard facet of post-conflict international assistance. Digging for the Disappeared provides readers with a window into this growing but little-understood form of human rights work, including the dangers and sometimes unexpected complications that arise as evidence is gathered and the dead are named. Adam Rosenblatt examines the ethical, political, and historical foundations of the rapidly growing field of forensic investigation, from the graves of the "disappeared" in Latin America to genocides in Rwanda and the former Yugoslavia to post–Saddam Hussein Iraq. In the process, he illustrates how forensic teams strive to balance the needs of war crimes tribunals, transitional governments, and the families of the missing in post-conflict nations. Police who engage in torture are condemned by human rights activists, the media, and people across the world who shudder at their brutality. Stark revelations about torture by American forces at places like Guantanamo Bay have stoked a fascination with torture and debates about human rights. Yet despite this interest, the public knows little about the officers who actually commit such violence. How do the police understand what they do? How do their beliefs inform their responses to education and activism against torture? Just Violence reveals the moral perspective of perpetrators and how they respond to human rights efforts. Through interviews with law enforcers in India, Rachel Wahl uncovers the beliefs that motivate officers who use and support torture, and how these beliefs shape their responses to international human rights norms. Although on the surface Indian officers' subversion of human rights may seem to be a case of "local culture" resisting global norms, officers see human rights as in keeping with their religious and cultural traditions-and view Western countries as the primary human rights violators. However, the police do not condemn the United States for violations; on the contrary, for Indian police, Guantanamo Bay justifies torture in New Delhi. This book follows the attempts of human rights workers to both persuade and coerce officers into compliance. As Wahl explains, current human rights strategies can undermine each other, leaving the movement with complex dilemmas regarding whether to work with or against perpetrators.

What does it mean to be a "rights-holder" and how does it come about? Remote Freedoms explores the contradictions and tensions of localized human rights work in far-flung Indigenous communities. Based on field research with the Anangu of Central Australia, this book investigates how universal human rights are understood, practiced, negotiated, and challenged in concert and in conflict with Indigenous rights. The Politics of Love in Myanmar offers an intimate ethnographic account of a group of LGBT activists before, during, and after Myanmar's post-2011 political transition. Lynette J. Chua explores how these activists devoted themselves to, and fell in love with, the practice of human rights and how they were able to empower queer Burmese to accept themselves, gain social belonging, and reform discriminatory legislation and law enforcement. Informed by interviews with activists from all walks of life-city dwellers, villagers, political dissidents, children of military families, wage laborers, shopkeepers, beauticians, spirit mediums, lawyers, students-Chua details the vivid particulars of the LGBT activist experience founding a movement first among exiles and migrants and then in Myanmar's cities, towns, and countryside. A distinct political and emotional culture of activism took shape, fusing shared emotions and cultural bearings with legal and political ideas about human rights. For this network of activists, human rights moved hearts and minds and crafted a transformative web of friendship, fellowship, and affection among queer Burmese. Chua's investigation provides crucial insights into the intersection of emotions and interpersonal relationships with law, rights, and social movements.

The Save Darfur movement gained an international following, garnering widespread international attention to this remote Sudanese territory. Celebrities and other notable public figures participated in human rights campaigns to combat violence in the region. But how do local activists and those throughout the Sudanese diaspora in the United States situate their own notions of rights, nationalism, and identity? Based on interviews with Sudanese social actors, activists, and their allies in the United States, the Sudan, and online, Branding Humanity traces the global story of violence and the remaking of Sudanese identities. Amal Hassan Fadlalla examines how activists contest, reshape, and reclaim the stories of violence emerging from the Sudan and their identities as migrants.
